Pas Perjalanan BAS.MY Johor Bahru

These are the Terms and Conditions which will apply to you when using the Pas Perjalanan BAS.MY. By using this service, you have unconditionally agreed to be legally bound by these Terms and Conditions that are outlined under the Pas Perjalanan BAS.MY product, general use, registration, service cancellation, termination, personal data, and among other things.

These Terms and Conditions govern the relationship between you as the “End User(s)” and the Pas Perjalanan BAS.MY on all BAS.MY Johor Bahru bus services.

1. CONDITIONS

1.1 These Conditions (“Conditions”) are effective from 1st April 2023 at 00:01 Malaysia Time and are binding on all persons to whom or on whose behalf a “Pas Perjalanan BAS.MY” is sold or acquired through “subscription“ using MyKad/MyTentera and/or through the LUGO APP.

1.2 The ‘Pas Perjalanan BAS.MY’ is initiated by the Ministry of Transport (MOT) Malaysia and supervised by Agensi Pengangkutan Awam Darat (APAD). This program is managed by Handal Indah Sdn Bhd (Company No.: 287467-M) (“HISB”), the Network Operator of BAS.MY Johor Bahru.

1.3 HISB works with other operators called “Regional Operators” (“RO”) to support the demand of 19 routes for this program in Johor. Other ROs include Maju, Transit Link, and S&S companies.

1.4 HISB is responsible for providing services needed by Pas Perjalanan BAS.MY for BAS.MY Johor Bahru bus services.

1.5 For the purposes of these Conditions:

  • “Pas Perjalanan BAS.MY” means a government-initiated program as an additional cashless payment method for all BAS.MY Johor Bahru using MyKad, Kad Konsesi, or the LUGO App.

  • “LUGO App” is the authorized application that allows end users to digitally register themselves to subscribe to any product(s) provided by Pas Perjalanan BAS.MY.

  • “Overseer” refers to the government agency (Agensi Pengangkutan Awam Darat “APAD” under the Ministry of Transport “MOT”) that oversees all services rendered under BAS.MY Johor Bahru.

  • “BAS.MY Johor Bahru” is a public transport service available around five corridors in Johor: Kota Tinggi, Pontian, Masai, Pasir Gudang, and Kulai.

  • “App Scanning” is an action required by end users to scan the QR Code using “LUGO Application QR readers” to access unlimited free passes under Kad 30 Hari or Kad Konsesi.

  • “Kad Konsesi” is a product of Pas Perjalanan BAS.MY Johor Bahru which offers a FREE Bus Ride to students aged 7–17, disabled individuals, the selected group of university or higher education institution students, and senior citizens aged 60 and above.

  • “Kad 30 Hari” is a product of Pas Perjalanan BAS.MY that allows end users to take unlimited free rides for 30 days upon subscription using their MyKad or LUGO App.

  • “Personal Details” refer to the required information provided by end users during registration via the counter or LUGO App.

  • “Counter” means authorized physical outlets or offices operated by the Network Provider to provide Pas Perjalanan BAS.MY information, including collection of Kad 30 Hari sales and replacement fees required for Kad Konsesi cards and other Pas Perjalanan BAS.MY products and services.

  • “Subscription” means the purchase of any product of Pas Perjalanan BAS.MY, as determined by HISB and other organizing bodies overseeing the overall execution of BAS.MY Johor Bahru.

  • “Service Providers” means the authorized company(ies) that operate BAS.MY Johor Bahru. This includes the Network Operator and Regional Operators of BAS.MY Johor Bahru.

  • “Causeway Link Website” refers to the official website for Pas Perjalanan BAS.MY and its related services and operations, operated and maintained by the Network Operator, with the homepage at www.causewaylink.com.my.

2. ELIGIBILITY

A. Kad 30 Hari Eligibility

2.1a – End user must be a Malaysian with a valid MyKad or MyTentera.

B. Kad Konsesi Eligibility

2.1b – End user must be a Malaysian with a valid MyKad or MyTentera.
2.1c – End user must be a student in a private or government educational institution within the age of 7–17 years old, following the year of birth.
2.2d – End user must be a senior citizen aged 60 years and above, following their year of birth, and must be a Malaysian citizen.
2.3c – For disabled passengers, he/she must have a valid Persons with Disabilities (OKU) card as proof during registration and must be a Malaysian citizen.
2.3d – The selected group of university or higher education institution students. He/she must be a Malaysian citizen.

3. GENERAL CONDITIONS OF USE

3.1 End users must present their MyKad, MyTentera, or LUGO App for verification during boarding or when requested by authorized personnel.

3.2 The Pas Perjalanan BAS.MY cannot be used by any other individual except the registered owner.

3.3 The card or pass remains the property of HISB at all times. HISB reserves the right to withdraw, deactivate, or cancel the usage if any misuse or fraudulent activity is detected.

3.4 Lost or damaged cards must be reported immediately to HISB through authorized counters or official communication channels.

3.5 Your Kad 30 Hari or Kad Konsesi is valid at all times unless it is invalidated or cancelled pursuant to these Conditions. Any authorized Counter and the back-end system of the LUGO App shall have the right, acting reasonably, to inspect your usage of Kad 30 Hari or Kad Konsesi at any time, including any travel history(ies) as and when required or ordered by authorities for legal matters.

3.6 HISB shall be responsible for ensuring that the Pas Perjalanan BAS.MY service is operated with reasonable care, skill, and diligence. If you discover any discrepancies in your Kad 30 Hari or Kad Konsesi usage, you should contact HISB via email at feedback@causewaylink.com.my.

3.7 HISB and the ROs reserve the right to amend or suspend any service routes or schedules under the Pas Perjalanan BAS.MY program, subject to operational requirements.

3.8 Any misuse, transfer, or falsification of the card/pass will result in permanent blacklisting and possible legal action.

3.9 HISB reserves the right to suspend or terminate access without notice for any breach of these Terms and Conditions.

3.10 HISB shall not be liable for any service interruption caused by force majeure events, including but not limited to natural disasters, system failures, or government restrictions.

4. SUBSCRIPTION OF KAD 30 HARI

4.1 The subscription of Kad 30 Hari can be done at any authorised Service Provider’s counter or via the LUGO App:

(a) Any authorised Counter is entitled to collect the sales of Kad 30 Hari from the end user representing the Subscription Cost;
(b) The subscription cost for Kad 30 Hari is RM50;
(c) The end user is required to subscribe to any of the Pas Perjalanan BAS.MY products (e.g. Kad 30 Hari) to enjoy unlimited free rides on all BAS.MY Johor Bahru routes.

4.2 Kad 30 Hari subscription is non-changeable after confirmation.

4.3 Your Kad 30 Hari subscription includes applicable taxes or any additional required payments. The total subscription cost is RM50 Nett, unless otherwise updated by the management of BAS.MY Johor Bahru.

4.4 Notwithstanding payment by you of the subscription fee, your subscription to Pas Perjalanan BAS.MY (e.g. Kad 30 Hari) shall at all times remain the exclusive property of BAS.MY Johor Bahru.

4.5 Reactivation fees for expired Kad 30 Hari are not required. Renewal of the Kad 30 Hari subscription is necessary if the end user wishes to continue enjoying the benefits of Kad 30 Hari.

4.6 The Service Providers or their authorised Counters, may, at their discretion, and acting reasonably, deny the use of any Kad 30 Hari if:
(a) The MyKad holder is suspected of using counterfeit, stolen, or tampered identification during registration;
(b) The MyKad used for registration in the LUGO App does not belong to the actual end user;
(c) The end user is not a Malaysian Citizen;
(d) The end user’s subscription to Kad 30 Hari (via MyKad or LUGO App) has expired.

5. SUBSCRIPTION OF KAD KONSESI

5.1 The subscription of Kad Konsesi can be done at any authorised Service Provider’s counter or via the LUGO App:

(a) This Pas Perjalanan is free for qualified recipients following Section 2.B.
(b) The subscription cost for Kad Konsesi is Free.
(c) End users will be required to pay a replacement fee if the first issued card is lost or damaged.

5.2 The renewal of Kad Konsesi is as follows:

  • For Students: The expiry of Kad Konsesi will be on 31 December of the year. Renewal will be open for 30 days before the expiry date.

  • For Persons with Disabilities and Senior Citizens: The Kad Konsesi validity period will be 365 days from the date of subscription. Renewal will be open for 30 days before expiry.

  • For Expired Kad Konsesi: The user must proceed to the counter for reactivation and bring all required eligibility documents stated under Section 2.

5.3 Issued Kad Konsesi cards are non-changeable after confirmation.

5.4 Notwithstanding the payment of the replacement fee, your access to Pas Perjalanan BAS.MY (Kad Konsesi) shall at all times remain the exclusive property of BAS.MY Johor Bahru.

5.5 Reactivation fees for expired Kad Konsesi are not required. Renewal can be done at the counter or via the LUGO App.

5.6 The Service Providers or their authorised Counters may, at their discretion and acting reasonably, deny the use of Kad Konsesi under the following conditions:
(a) The MyKad holder is suspected of using counterfeit, stolen, or tampered identification during registration;
(b) The MyKad or MyTentera used for registration in the LUGO App does not belong to the actual end user;
(c) The end user is not a Malaysian Citizen;
(d) The end user’s subscription to Kad Konsesi (via MyKad, MyTentera, or LUGO App) has expired.

6. CANCELLATION AND REFUND

6.1 Once a subscription is successful, whether via an authorised counter or LUGO App, no refunds are allowed for any reason.

6.2 You may cancel your Kad 30 Hari subscription at any time by discontinuing use of the product on BAS.MY Johor Bahru services.

6.3 Upon cancellation, refunds are strictly not allowed.

6.4 For Kad Konsesi replacement fees, refunds are not allowed after a successful transaction unless the card is found to be faulty within 7 days of issuance.


7. ADVERTISING AND PROMOTION

7.1 BAS.MY Johor Bahru, its operator, or authorised agents may use images, names, or likenesses of passengers for promotional or advertising purposes related to BAS.MY Johor Bahru without additional consent, provided no personal data is disclosed without permission.

7.2 The Service Provider reserves the right to promote related transportation products or services to all registered users of Pas Perjalanan BAS.MY through digital or printed media.

8. LUGO APP USAGE

8.1 All users of Kad 30 Hari or Kad Konsesi are encouraged to download and register with the LUGO App to manage their Pas Perjalanan conveniently.

8.2 The LUGO App enables the end user to:

  • Check subscription validity;

  • View BAS.MY route information;

  • Receive real-time service updates;

  • Renew or apply for eligible Pas Perjalanan products;

  • Contact customer support.

8.3 Users must ensure the MyKad or MyTentera number registered in the LUGO App matches their actual identification number. Mismatched registrations will result in account suspension.

8.4 BAS.MY Johor Bahru and the Service Provider shall not be held responsible for:
(a) Any errors resulting from incorrect data entry during registration;
(b) Any losses or damages arising from the misuse of login credentials;
(c) Technical disruptions or downtime of the LUGO App or related systems.

9. USAGE OF MYKAD OR MYTENTERA

9.1 The registered MyKad or MyTentera functions as an identification medium for the user’s Pas Perjalanan subscription.

9.2 End users are responsible for ensuring that the MyKad or MyTentera is active and functional.

9.3 Any replacement of MyKad or MyTentera may require reactivation or re-registration of the Pas Perjalanan.

9.4 BAS.MY Johor Bahru and its Service Providers shall not be liable for any issues arising from damaged or malfunctioning MyKad or MyTentera chips.

10. VALIDITY PERIOD

10.1 Kad 30 Hari: Valid for 30 days from the date of successful activation.

10.2 Kad Konsesi:
(a) Students – Valid until 31 December of the registered year;
(b) Persons with Disabilities and Senior Citizens – Valid for 365 days from the activation date.

10.3 Expired Pas Perjalanan cannot be used for boarding until renewed.

10.4 The validity of a Pas Perjalanan cannot be extended beyond the stated duration. Users must renew to continue usage.

11. LOST OR DAMAGED CARD POLICY

11.1 If a card linked to Pas Perjalanan BAS.MY is lost or damaged, the user must report it immediately to the Service Provider or at the authorised counter.

11.2 The user must provide proof of identification (MyKad or MyTentera) for verification before a replacement is issued.

11.3 Replacement fees apply as follows:

  • Kad 30 Hari: No replacement required; simply re-subscribe.

  • Kad Konsesi: Replacement fee applies as determined by the Service Provider.

11.4 BAS.MY Johor Bahru is not responsible for misuse of lost or stolen cards before official reporting.

12. TRANSFER AND NON-TRANSFERABILITY

12.1 All Pas Perjalanan BAS.MY products are non-transferable.

12.2 The Pas Perjalanan must only be used by the registered MyKad or MyTentera holder.

12.3 Any misuse, including sharing or transferring usage rights, may result in immediate suspension of the Pas Perjalanan.

12.4 BAS.MY Johor Bahru reserves the right to blacklist any user found violating these terms.

13. SERVICE AVAILABILITY

13.1 BAS.MY Johor Bahru aims to ensure continuous service for all routes covered under the Pas Perjalanan program.

13.2 However, service interruptions may occur due to:
(a) Technical issues;
(b) Road closures or unforeseen incidents;
(c) Government-imposed restrictions;
(d) Force majeure events.

13.3 In such cases, BAS.MY Johor Bahru will make reasonable efforts to restore service promptly but shall not be liable for losses or inconvenience.

14. DATA PROTECTION

14.1 BAS.MY Johor Bahru and its Service Providers collect and process user data in accordance with the Personal Data Protection Act 2010 (PDPA).

14.2 User information will only be used for:

  • Service administration and verification;

  • Product updates and improvements;

  • Communication of relevant promotions or notices.

14.3 Personal data will not be shared with third parties except as required by law or for service operations.

14.4 By subscribing to any Pas Perjalanan, the user consents to the processing of their personal data as outlined above.

15. TERMINATION AND SUSPENSION

15.1 BAS.MY Johor Bahru reserves the right to suspend or terminate any Pas Perjalanan BAS.MY product if:
(a) Fraudulent activity is detected;
(b) Misuse of MyKad or MyTentera is confirmed;
(c) The user provides false or misleading information;
(d) The user breaches any terms stated herein.

15.2 Suspension or termination will be communicated to the user through official channels (email, SMS, or LUGO App notification).

15.3 No refunds will be issued in the event of termination due to breach of terms.

16. AMENDMENTS TO TERMS AND CONDITIONS

16.1 BAS.MY Johor Bahru reserves the right to amend, add, or remove any part of these Terms and Conditions at any time.

16.2 Updated Terms and Conditions will be published on the official BAS.MY Johor Bahru website and/or LUGO App.

16.3 Continued use of the Pas Perjalanan after such amendments constitutes acceptance of the revised Terms.

17. LIABILITY

17.1 BAS.MY Johor Bahru and its Service Providers will not be liable for:
(a) Any loss of profit, income, or business opportunities;
(b) Any indirect, incidental, or consequential damages;
(c) Any loss arising from misuse or unauthorised access to Pas Perjalanan.

17.2 Liability is limited strictly to the value of the Pas Perjalanan subscription fee.

17.3 This limitation does not exclude liability for death or personal injury caused by proven negligence.

18. GOVERNING LAW

18.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia.

18.2 Any disputes arising from the use of Pas Perjalanan BAS.MY shall be subject to the jurisdiction of the courts of Malaysia.

19. GENERAL PROVISIONS

19.1 These Terms and Conditions constitute the entire agreement between the user and BAS.MY Johor Bahru regarding the Pas Perjalanan BAS.MY program.
They supersede all prior communications, understandings, or representations, whether written or oral.
